Please read these Terms of Service ("Terms") carefully before using the TFSA Can mobile application (the "App"). By downloading or using the App, you agree to be bound by these Terms.

1. Disclaimer: Not Financial Advice

CRITICAL: TFSA Can is a tracking and estimation tool only.

  • No Professional Advice: The App does not provide legal, tax, investment, or financial advice. The calculations and information provided are for educational and tracking purposes only.
  • Not Official: The App is not affiliated with, endorsed by, or connected to the Canada Revenue Agency (CRA) or any financial institution.
  • Consult a Professional: You should always consult with a qualified accountant, financial advisor, or tax professional before making significant financial decisions.

2. Accuracy of Information

While we strive to ensure the App's logic aligns with current CRA rules (e.g., T4040, RC4466):

  • Estimates Only: Contribution room calculations are estimates based on the data you enter. If your inputs are incomplete or incorrect, the results will be incorrect.
  • Verifying Data: It is your sole responsibility to verify your actual contribution room and deduction limits via your CRA "My Account" portal or your Notice of Assessment.
  • Rule Changes: Tax laws and limits (e.g., annual TFSA limits) are subject to change. While we aim to update the App to reflect these changes, we cannot guarantee immediate compliance with new legislation.

3. Limitation of Liability

To the maximum extent permitted by law:

  • No Liability for Penalties: The Developer and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to tax penalties, interest charges, or financial losses resulting from your reliance on the App's calculations.
  • "As Is" Basis: The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.

4. User Responsibilities

  • Data Entry: You are responsible for the accuracy of all data entered into the App (e.g., past contributions, withdrawals, birth year).
  • Security: You are responsible for securing access to your mobile device to prevent unauthorized viewing of your financial data.

5. Intellectual Property

The App and its original content, features, and functionality are owned by the Developer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
